After the recent tightening of their borders by creating new rules and laws to deter immigrants from coming down to settle in their countries, most european countries are now facing new challenges or should I call it self invented loop holes that allow gays and homosexual’s to be considered base on threat to their life as a result of their sexual orientation. Now a large number of immigrants claiming asylum are gay. In 2017, the Home Office released data that showed that for the past two years more than 66% of asylum seeker applicants are gay. Recently Chinedu (not real name) a Nigerian asylum seeker submitted an application to stay in Hungary for the fear of being killed if he travels back to Nigeria but his application was rejected after psychologist’s did not find any trace of being gay after he failed all the test conducted on him.
Chinedu applied for asylum in the Hungarian city of Szeged back in 2015, saying that he could not return to his home country for fear of his safety as a gay man because homosexuality is illegal in Nigeria, with the maximum penalty of death by stoning. However, immigration officials didn’t believe his plea and forced him to undergo psychological testing to prove his sexuality which he failed in fact he got F9.
Trust my guy, he showed the Hungarian authority ‘pepper’ by taking them to the International Court of Justice by sticking to his gay story, however he was lucky as the court of justice in Luxembourg ruled in his favour stating that the government have no right to force him to prove his sexuality through tests as that’s interfering with his privacy. Chinedu’s refugee application will now be reconsidered in light of this decision. Mores so, all the 28 EU state members must adhere to the new ruling, including Britain which means that EU countries now have No legal right to impose psychological tests to determine an asylum seeker’s sexuality.
